All holidays should be taken before 31-12-2022. Only holidays beyond 4 weeks (5th holiday week) can be paid out or transferred. The rest goes to the Holiday Fund (To be reported by 15 November 2023 at www.virk.dk). The only exception to this is holiday hindrance (illness, maternity leave, military service, etc. - see exhaustive list here: What is holiday hindrance?)

The deadline for entering information about the transfer of holiday due to holiday disability in the self-service solution at Virk.dk is 31 January 2023.

 

Holiday beyond 4 weeks (5th holiday week) can be paid out or carried over to the next holiday year

However, there may be collective agreements that limit the possibility of transferring holiday.

 

Payment of holiday beyond 4 weeks (5th holiday week)

With the new holiday law, your employees are entitled to receive excess holiday beyond 4 weeks (5th holiday week) without taking the holiday.

Hourly and salaried employees

If the holiday pay has already been reported to FerieKonto/Feriepengeinfo, your employee must request payment of the holiday by logging in to the self-service solution 'Se og bestil feriepenge' at borger.dk. This applies to hourly-paid and retired salaried employees.

If your employee has received certain public benefits, the number of days the employee has received the benefits will be deducted from the number of days of holiday beyond 4 weeks (5th holiday week) - unless the employee has been prevented from taking holiday.

If your employee has received public benefits for more days than there are holiday days beyond 4 weeks (5th holiday week), the employee cannot be paid for the holiday days.

Employees with holiday pay entitlement (salaried employees)

If your employee is employed in a non-terminated position and has been so for the entire holiday period, you must pay the holiday pay directly to the employee.

Your employee must fill out Excess holiday form and hand it over to you. You are obliged to save the form according to the rules of the Bookkeeping Act.

If your employee has received certain public benefits during the holiday period, you are not allowed to pay the holiday pay to the employee.

In this case, the employee must send the form to FerieKonto, which will decide on the payment and send the decision directly to the employee.

The following public benefits are deducted from your holiday entitlement:

  • Unemployment benefits
  • Temporary labour market benefit
  • Cash benefit
  • Early retirement
  • Flexible benefits
  • Unemployment benefit
  • Resource programme benefit
  • Integration benefit
  • Educational assistance
  • Social assistance

Your employee must disclose the above benefits when requesting payment. If the employee has received one of these public benefits, the deadline for requesting payment is 30 September 2023 at the latest for the holiday period 01-09-2021 - 31-12-2022.

Transfer of holiday beyond 4 weeks (5th holiday week)

An employer and an employee can enter into an agreement to carry over holiday beyond 4 weeks (5th holiday week) to the next holiday period. However, there may be collective agreements where the possibility to carry over holiday is limited.

The deadline for entering information about transferring holiday beyond 4 weeks (5th holiday week) in the self-service solution at Virk.dk is 31 December 2022, when the holiday entitlement period ends.

Before transferring holiday beyond 4 weeks (5th holiday week), you must make a written agreement. Your employee is not entitled to carry over holiday if you don't agree.

Requirements for the written agreement

When you make an agreement on holiday carryover, there are the following requirements:

  • The agreement must be concluded before 31 December 2022.
  • The employee must be employed at the time of the agreement.

Holiday pay (salaried employees)

If your employee is entitled to salary during holiday and is still employed, you mutually agree to carry over holiday beyond 4 weeks (5th holiday week). This does not need to be entered at Virk.dkthat the holiday is carried over.
